ACC AustraliaESG (Environmental Social and Governance) concerns and risks are a growing focus for businesses. But what are they and why are they important? Is ESG the same as CSR (Corporate Social Responsibility)? Is this the same as "Corporate Sustainability"? Why do people keep talking about "supply chains" in this context? How do Diversity and Inclusion fit into these concepts? And even more importantly - what should Corporate Counsel know and do about all of this?
In this session experts from Baker McKenzie will get to the bottom of these buzz words. They will identify some of the relevant international instruments and look at the local legal framework. By way of case studies, Sarah and Sean will talk about modern slavery reporting (locally and globally) and diversity and inclusion programs (what they should now encompass and what new initiatives corporates should now consider rolling out).
Speakers
Sean has more than 30 years' experience advising small and large corporations, multinational businesses and senior executives in relation to employment and industrial law.
Sean practices in all areas of employment law and litigation, including the preparation of contracts and policies, advice about entitlements, restructuring advice and representation in disputes (dismissals, discrimination, post-employment restraints and confidentiality).
Sean has special interests in non-standard labour practices (such as labour hire and the use of casual employees and independent contractors) and supply chain transparency, with a particular focus on labour law compliance and modern slavery in local and global supply chains.
Sean also practices in industrial law with a particular emphasis on the development of industrial relations strategies, the making of enterprise agreements (including scope and good faith bargaining disputes and protected action ballot order applications) and representation in disputes.
He appears in all relevant jurisdictions –— the Fair Work Commission, all Victorian and Federal courts, the Victorian Equal Opportunity and Human Rights Commission, the Victorian Civil and Administrative Tribunal and the Australian Human Rights Commission.
Sara Summerbell, Special Counsel
Sara Summerbell is a special counsel in the Employment Practice Group. Prior to joining Baker McKenzie, Sara was a principal and managing counsel for BHP, one of the world's leading energy and resources companies. With BHP, Sara worked in the United States, across South America, Asia Pacific and the UK. Before working in-house, she spent seven years at a top-tier international law firm specializing in employment and labor relations law.
An experienced presenter and legal educator, Sara has developed and facilitated extensive training programs to executives, HR teams, in-house counsel and industry groups on a wide range of employment law issues.
Sara has appeared in Federal and Victorian Courts as well as tribunals including the Fair Work Commission and the Australian Human Rights Commission.
With in-depth, global in-house experience, Sara understands the challenges faced by HR teams, managers and legal counsel. Sara provides practical and commercial advice across the employment relationship cycle, from recruitment to termination of employment as well as inclusion and diversity, industrial relations and employment-related litigation. Sara advises a range of clients and has been seconded to the mining, consumer goods and not-for-profit sectors, as well as to the Fair Work Ombudsman.
