- Session I – 9:00 a.m. to 10:00 a.m. Litigating Complex Legal Issues Under the Scrutiny of Public Opinion presented by Manko, Gold, Katcher & Fox LLP
More and more, Pennsylvania has been the scene of highly visible and controversial projects that have been challenged by opponents before agencies, administrative appeals boards and state and federal courts. With the advent of social media, and real time transmission of testimony through that social media, litigating these issues is more visible and raises many issues, including how to message to both the judge and the wider public audience at the same time, how to limit public interference in those proceedings, how to use social media statements in cross examination of opposing witnesses and how to avoid testimony in one matter being used adversely in other matters, civil and criminal. Using real world examples, this session addresses these and other issues.

- Session II – 10:30 a.m. to 11:30 a.m. Be an Expert at Experts: Expert Mistakes and How Best to Avoid Them presented by Obermayer Rebmann Maxwell & Hippel
Expert witnesses serve a critical role in litigation, particularly in complex cases. Experts are especially critical in cases where lay witnesses are unable to proffer the evidence necessary for the party to secure a favorable verdict. Notwithstanding an expert’s import, many attorneys make simple mistakes in choosing and presenting the expert, including some which lead to the expert’s disqualification. Disqualification can be fatal to a case, as, at least in federal court, only expert witnesses are permitted to opine as to the case’s ultimate issue.
