In this session, Baker McKenzie’s Competition & Consumer Partners Georgina Foster, Helen Joyce and Lynsey Edgar will discuss best practice and provide you with practical tips for responding to ACCC investigations. The presentation will cover issues such as managing a dawn raid, responding to a section 155 notice, preparing for a compulsory examination, privilege and the enforcement options available to the ACCC. The presentation will provide an update on recent cases, and suggest strategies for in-house counsel when dealing with the regulator.

Georgina Foster

Georgina Foster, Partner

Georgina is a leading merger clearance lawyer. She also regularly advises clients on competition law issues relating to joint ventures and strategic alliances, cartel conduct, as well as pricing and distribution strategies. She has significant experience in representing clients in ACCC investigations into alleged contraventions of Australian competition and consumer laws, including acting for immunity applicants. She also regularly assists clients with competition and consumer law compliance programs.

 

Helen Joyce

Helen Joyce, Partner

Helen has extensive commercial litigation experience, advising clients on a broad range of matters including complex contractual disputes, competition, white collar fraud and regulatory investigations, and schemes of arrangement. In addition to her skills as a litigator, Helen has extensive experience representing clients in formal and informal negotiations and other forms of alternative dispute resolution including mediation and arbitration.

 

Lynsey Edgar

Lynsey Edgar, Partner

Lynsey's practice focuses on competition investigations, enforcement litigation and regulatory matters. She assists clients with complex merger clearances, advises on highly technical aspects of competition/antitrust law, and has a particular expertise in cartels including immunity applications.

Lynsey also advises on consumer issues including misleading and deceptive conduct, consumer guarantees, advertising, unconscionable conduct, and compliance with the Australian Consumer Law.

Lynsey has significant experience defending clients facing investigations by regulators, particularly the ACCC, and assists clients to effectively resolve commercial disputes involving competition and consumer law claims.
