The attorney-client privilege is paramount to any legal representation.  But, it can be wrought with pitfalls if parties are not careful to conduct themselves appropriately to protect the privilege. This presentation will provide an overview of the attorney-client privilege, particularly as it relates to the role of in-house counsel.  The panel will discuss situations often faced by in-house counsel and the best practices for navigating these scenarios to avoid unintentional waiver.  Among other topics, the panel will discuss:

  • The scope of the attorney-privilege and its application to in-house counsel
  • How the privilege applies in matters involving joint representation
  • When dual purpose communications are protected
  • The role of privilege in internal investigations
  • How to avoid waiver in cross-border communications
