Overview (Program Summary)

This interactive workshop facilitated by LK will explore in-house counsel’s role in responding to legal and ethical issues arising from conflicts and other difficult situations that might arise in an organisation. 

Through a case-study that will guide our discussion, we will use the collective wisdom and experience of attendees to delve into some of the legal and ethical issues that in-house counsel may face or be required to address when a technical or organisational conflict arises.  We will explore the impact of culture on critical decisions by in-house teams, and consider obligations under the Solicitor Conduct Rules, and how they guide and impact upon decision-making.

This session will form the first of a two-part series on the impact of conflict with a Breakfast Briefing to follow that will look at techniques for addressing and resolving conflict within the workplace.

Lisa Loechel, Principal, LK

Lisa has experience across a broad range of commercial disputes, for Australian and international clients, involving a variety of issues and industries, from construction to agriculture to financial services.

Lisa has significant experience with large-scale complex litigation, involving complicated forensic investigations and document and data management, including eDiscovery and electronic trial platforms.

Lisa has conducted cases before the Supreme Court of South Australia and New South Wales, the Federal Court of Australia and Royal Court of Guernsey, as well as arbitrations under the ACICA rules. Lisa has also acted in a number of matters resolved successfully at mediation.  

Lisa advises corporate clients on governance, risk minimisation and strategies for avoiding disputes, regulatory compliance and internal investigations, and has a particular passion for assisting clients in new tech and emerging industries.

Lisa builds strong constructive relationships with clients and other professionals who appreciate her thorough, pragmatic and personable approach and is well known among her colleagues for her capacity to absorb and recall complicated detail, and her unquestionable grit.

 

Amy Cooper-Boast, Principal, LK

Amy Cooper-Boast, Principal, LK

Amy has over 15 years of Australian and international experience in complex commercial disputes, spanning Australia, the UK, Hong Kong, Singapore, the Cayman Islands, the BVI, Canada and the US.  She has litigated prominent claims against directors, officers and auditors for breach of duty, negligence, fraud and misconduct.  She has also advised clients on high value insolvency and restructuring projects, and other legal and regulatory issues including contracts, compliance, data, trade practices and intellectual property.  

Amy has advised across a variety of industries, including financial services, insurance, manufacturing, mining, medical technology, agribusiness, infrastructure, telecommunications, government and arts. 
Clients appreciate her integrity and collegiate style, her excellent legal, analytical and project management skills, and her tenacity and steady hand in resolving their sensitive commercial disputes. 

With a deep understanding of corporate governance issues, Amy is also a committed not-for-profit Board member.  In addition, she leads LK’s pro bono work for JusticeNet SA’s Refugee and Asylum Seeker Project.
