Overview (Program Summary)

This webinar, presented by Gilbert + Tobin’s market-leading Technology + Digital team, will look at recent case law and the techniques and rules used to construe real examples of contract clauses. 

The session will consider the following important questions:

  • Can ‘commercial purpose’ override the literal meaning of the language used;
  • Can a court ‘rewrite’ or ‘fix’ the bargain by construction?;
  • How can you protect the construction you want when drafting?

This webinar is targeted at commercial lawyers who draft and advise on commercial contracts.

Andrew Hii

Andrew Hii, Partner, Gilbert + Tobin

Andrew is a technology lawyer, digital expert and partner in Gilbert + Tobin’s Technology + Digital group.

Andrew advises on a wide range of technology and digital projects, including privacy, data and AI, cloud computing, systems development and integration, IT and business process outsourcing, 

government procurement and internet regulation. 

His work also includes advising on data and technology issues in strategic M&A transactions. 

Andrew particularly specialises in advising entities operating in regulated sectors (including financial services, health and telecommunications), and helping them navigate the intersection between commercial and regulatory demands.  This experience will be relevant to a wider range of sectors with the proposed introduction of new Critical Infrastructure Laws that will cover a wide swathe of the Australian economy.

 

Jen Bradley

Jen Bradley, Senior Lawyer, Gilbert + Tobin

Jen is a Senior Lawyer in Gilbert + Tobin’s Technology + Digital practice working primarily in technology, telecommunications, and general commercial law. 

She advises a range of listed and non-listed public and private companies and Government entities on complex IT transformation projects, IT infrastructure and business process outsourcing, systems development and integration, software licensing and other bespoke commercial arrangements.  

Jen’s practice also includes associated regulatory issues including privacy, data protection and consumer law compliance, data commercialisation and emerging and disruptive technology considerations (such as artificial intelligence and internet of things).
