Overview (Program Summary)

ACC AustraliaIn May 2020, damage to the area of the Juukan Gorge in the Pilbara resulted in the destruction of two ancient rock shelters, estimated at around 46,000 years old, with cultural significance to the Puutu Kunti Kurrama and Pinikura People. The destruction of these sacred sites brought international attention to the importance of Indigenous cultural heritage within broader environmental, social and governance (ESG) considerations.
This session, hosted in conjunction with Gilbert + Tobin will explore Aboriginal heritage sensitivities as part of a company’s ESG obligations following the Juukan Gorge incident and the subsequent Parliamentary Inquiry.
It will focus on both the legal ramifications of compliance with the current and incoming Aboriginal Heritage legislation but also the ‘social licence to operate’ ramifications of not maintaining good relations with relevant Traditional Owners.

Marshall McKenna, Disputes + Investigations Partner, Gilbert + Tobin
Marshall’s practice focusses on commercial litigation with a recognised speciality in native title and mining law.
He has achieved positive outcomes for his clients in relation to several native title and mining matters (in both the Warden's Courts and the Supreme Court), in significant trust remediation matters, enforcement of confidentiality obligations, restraints of trade and employment obligations.
He also has a breadth of experience advising on land access and planning and environmental approvals, Freedom of Information issues and is also active in negotiating and documenting compensation, heritage and land access agreements.
Arabella Tolé, Disputes + Investigations, Gilbert + Tobin
Arabella Tolé is a senior associate in the Disputes + Investigations team in Perth. Arabella has extensive experience in litigation both within Australian and foreign jurisdictions, including on the Royal Commission into the Detention and Protection of Children in the Northern Territory (NTRC) and in numerous native title and mining matters in the Perth Warden’s Court, the National Native Title Tribunal, the Supreme Court of Western Australia and Federal Court of Australia.
Arabella has also assisted on international arbitrations and numerous and commercial disputes in the District and Supreme Courts of Western Australia, the WA Court of Appeal and the Federal Court of Australia.
Arabella has assisted in litigation, and energy and resources matters both within Australian and foreign jurisdictions.
