ACC AustraliaThe protection of trade secrets and confidential information can be paramount to the commercial success of a business. With the transition to working-from-home, businesses are facing technological and practical challenges as they seek to protect their confidential information from theft or misuse by employees.
This webinar presented by Gilbert + Tobin’s Employment team, will cover measures that you can implement to protect your confidential information, including:
- implementing security measures, including usage monitoring and other surveillance practices;
- having robust contractual protections and IT usage policies; and
- developing and implementing procedures to ensure high-risk employees’ devices are monitored and examined to ensure that confidential information is protected.
This session will also cover the steps an employer could take if its security measures fail, including obtaining personal devices for forensic examination, injunctive relief requiring the return of information and damages for breach.

Kaushalya Mataraaratchi, Special Counsel, Disputes + Investigations/Employment, Gilbert + Tobin
Kaushalya provides employment advice in both advisory and litigious matters. Kaushalya’s practice focuses on acting for employers in complex, high-value employment disputes in the Federal and Supreme Courts.
She has a proven track record, successfully enforcing post-employment obligations, pursuing employees involved in high-value breaches of their employment contract and defending claims brought by employees following their termination.
Kaushalya has expertise in the new whistleblower laws and securing employer confidential information following significant data breaches by employees. She represents clients in Federal and Supreme Court proceedings, defending allegations and pursuing injunctions, claims for, damages and equitable relief. She has acted for clients across multiple industries, successfully representing them in a range of forums including before the corporate and consumer regulators, in international arbitration and mediation.
Dianne Banks, Partner, Disputes + Investigations/Employment, Gilbert + Tobin
Dianne is a partner in the Disputes + Investigations group, whose practice focusses on employment and industrial law.
In particular, Dianne specialises in strategically complex and business-critical disputes and investigations. Her expertise includes employee data and confidentiality breaches, post-employment restraint enforcement, employee fraud, performance management and termination, executive terminations, and investigations into discrimination, sexual harassment, misconduct and critical WHS incidents. She is an experienced employment litigation lawyer acting in all courts and tribunals in which employment-related disputes are litigated including Fair Work Australia, the NSW Supreme Court, Federal Circuit Court and the Federal Court of Australia.
Dianne has also been at the forefront of advising employers on distributed workforces and the opportunities and challenges that arise from a decentralised model of working. This includes considerations of performance management, work health and safety, data security and compliance, employee surveillance and privacy. Dianne assists clients in implementing and managing the practicalities of flexible working, to ensure their businesses are ‘future proofed’ to succeed in a post-COVID world.
