Enforcement of Judgements and Awards in India – Effective Strategies

Historically, the Indian judiciary has been perceived as a tardy jurisdiction, primarily, due to lengthy trials and inordinate delays caused to enforce foreign judgements and awards. In the past few years both, the Indian legislature and judiciary has taken few initiatives to uplift the sentiment of foreign investors / litigants. Few legislative amendments coupled with some landmark cases have been effective and helpful in expediting enforcement actions in Indian courts. Nevertheless, it is imperative for a foreign entity to adopt an impeccable legal strategy when it comes to enforcement of foreign judgements and awards in India.
