The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth), which was passed by the Government on 7 December 2022, contains some of the most significant industrial relations reforms since the Fair Work Act 2009 (Cth) was enacted. These reforms will have major implications for Australian businesses across all industries and sectors.  

Key changes include: 

  • expansion of multi-employer enterprise bargaining, reduced barriers to Fair Work Commission arbitration and changes to the approval process for enterprise agreements;  
  • limitations on the use of fixed term employment contracts; 
  • abolition of pay secrecy provisions in employment agreements; 
  • new prohibitions on sexual harassment; 
  • greater powers of the Fair Work Commission to settle disputes relating to flexible working arrangements and parental leave extensions; and  
  • empowering the FWC to make equal remuneration orders. 

This session will: 

  • provide an overview of the specific changes that came into effect on 7 December 2022, and those that will take effect in June and December in 2023; 
  • outline what these changes mean for Australian businesses; and 
  • explore the role of in-house counsel to help Australian businesses prepare for the remaining changes which come into force later in 2023.

Tom Brett

Tom Brett, Partner, Gilbert + Tobin 

Tom is a Partner in the Disputes + Investigations team whose practice focusses on both contentious and non-contentious employment matters.  

Tom advises clients across the full scope of employment law and industrial relations, bringing a pragmatic solutions-based approach that is highly attuned to balancing legal, commercial and people-based issues in the workplace. Tom regularly advises on executive terminations, workplace investigations, post-employment restraints and the employment implications of commercial transactions.  

Tom’s practice includes advising large public listed organisations, private equity and venture capital, with particular experience in the financial services, construction and technology sectors. Tom regularly acts for public and private sector clients in litigation in the Federal Circuit Court of Australia, Federal Court of Australia and the Fair Work Commission (including but not limited to appellate jurisdictions, general protections, unfair dismissal and discrimination-based claims).  

 

James Pomeroy

James Pomeroy, Special Counsel, Gilbert + Tobin 

James is a Special Counsel in the Disputes + Investigations team who specialises in employment law.   

James advises employers on the complete range of employment related claims, including statutory claims such as unfair dismissal, general protections applications, employment misrepresentations claims and discrimination matters, as well as contractual matters such as enforcing post employment obligations.  

He also has extensive experience in relation to the employment implications of commercial transactions, advising employers on the transfer of employee entitlements and industrial instruments when a business is transferred from one employer to another and outsourcing. This experience includes working on major transactions requiring employment due diligence.
