Increasingly sophisticated cybercriminals and increasingly voluminous payloads of personal information are creating a perfect storm for both the private and public sector.

Melissa Fai, Partner, Gilbert + Tobin - Tech + IP Group
Melissa is a partner in Gilbert + Tobin’s Tech + IP group. She is a cyber security, data and privacy specialist who dedicates a significant part of her practice to advising Australia’s leading corporates on cyber security, privacy and data protection obligations in light of how clients use technology and data in their operations and transactions. She advises on complex issues surrounding cyber and data breaches and assists clients to understand their regulatory obligations under the mandatory notifiable data breach regime.
Her practice is a real mix of complementary commercial and regulatory work. As well as her cyber security, data and privacy expertise, she advises on complex commercial contracting arrangements, such as strategic outsourcings, IT and related procurement or supply transactions, and the data, privacy and IT aspects of significant M&A transactions. This includes data and privacy separation and transition issues.
Simon Burns, Partner, Gilbert + Tobin - Tech + IP Group
Simon is a partner in Gilbert + Tobin’s Tech + IP group. Simon’s practice includes advising on all aspects of data and technology intensive transactions, including with respect to cyber and data breach response, including ransom response and associated regulatory compliance regimes associated with risks that ransom payments result in funding terrorists or criminal activity.
Simon’s experience includes advising senior management on the adoption of emerging technology and digital platforms, including distributed ledger technologies, robotics/artificial intelligence, new payment systems and other FinTech. He is an expert on the outsourcing of key business operations and the commercialisation of business assets, including data. He also has experience developing novel multi-party sourcing models and negotiating large scale “bet the farm” technology deals.
