ACC AustraliaCyber-crime is a rapidly growing and evolving issue for businesses large and small. Cyber criminals are becoming increasingly daring and their methods are increasingly sophisticated. From small scale "phishing" to handling major data breaches, commercial organisations and their lawyers need to keep up with developments in this rapidly changing area in order to manage the risk that it presents. That risk includes the potential for legal liability to those whose private information they hold such as customers, as well as to shareholders and others who can be affected by an attack on their organisation. This session will examine the potential liability that commercial organisations may be exposed to in the aftermath of an attack as well as potential responses to a major data breach. It will also examine the expectations of regulators, Courts and insurers as to ways in which cyber risk might be managed.

Kate was called to the Bar in 2002, after obtaining an LL.M from Harvard Law School and practising at Sullivan & Cromwell in New York.
Kate has extensive experience in a range of private and public law litigation and has appeared in the High Court, NSW Court of Appeal, Supreme Court, Federal Court, the Land and Environment Court as well as a range of quasi-judicial and administrative tribunals. Kate is ranked in the Doyle's Guide (2022, 2021) as a leading Senior Counsel in Administrative and Public law in Australia. She also has particular expertise in regulatory matters, privacy, disciplinary proceedings, professional liability, environment and planning, public inquiries and coronial inquests. Her clients have included major corporations, federal and state government Ministers and agencies, professionals of all kinds and their insurers.
Speaker: Stephen Free SC, Eleven Wentworth
Stephen Free SC practises nationally, undertaking trial and appellate work in a range of areas in State and Federal Courts. He specialises in public and commercial law matters, including class actions, competition, civil penalty, planning and regulatory matters. Stephen appeared for the defendant in Evans v Health Administration Corporation, the only data breach class action to have been resolved in Australia so far. Stephen has appeared in a number of significant class action matters, including for Westpac in the High Court matter of BMW v Brewster; Westpac v Lenthall, concerning the validity of common fund orders. He appeared for the successful applicants in the Live Cattle class action (Brett Cattle Company v Minister for Agriculture), for the Commonwealth in the class actions concerning PFAS contamination at Airforce Bases, for Volkswagen in the Takata Airbag class action and for the claimant class in the defective product claim of Williams v Toyota.

Matt O’Kane is an accomplished digital forensics and cyber incident responder. He has over 20 years of experience in the information technology industry. He is the founder and CEO of Notion Digital Forensics. Notion (headquartered in Sydney) provides digital forensics, incident response, and cyber security consulting services to clients across various industries. Before founding Notion Digital Forensics, Matt held leadership roles in dotcom and online marketing firms. He is passionate about helping organisations build strong cyber security postures. He has worked with clients ranging from small businesses to large multinational organisations. Matt teaches at UNSW Canberra (city and Australian Defence Force Academy campus) and UNSW Law Edge in Sydney. He is also gives regular guest lectures at international universities.

David heads up the Information Technology Liability and Cyber Insurance portfolios for Liberty Specialty Markets in Asia Pacific.
David graduated with a Bachelor of Science in Physics and a Bachelor of Commerce in Economics. He began his insurance career working in a range of underwriting and broking roles within the professional lines area of the insurance industry and joined Liberty 15 years ago to spearhead the launch of their IT Liability and Cyber insurance products into the Asia Pacific market.
His role includes setting underwriting strategy, underwriting guidelines, modelling losses, and the risk assessment of accounts from a diverse range of industry segments and provides opportunity for unique insights and input into the risk management and incident response frameworks of insureds.
