ACC AustraliaLegal professional privilege has been described as a civic right. It enables companies to seek and obtain legal counsel in the confidence that their communications with lawyers will not be disclosed without their consent.
The interplay between legal professional privilege and the role of in-house counsel is complex. There may be times when communications with an in-house counsel are not privileged even though those same communications would be privileged if sent to external counsel. Claims of legal professional privilege are additionally being increasingly scrutinised by regulators such as the Australian Taxation Office.
This session will provide an update on recent developments in relation to legal professional privilege as it applies to in-house counsel, and provide strategies to enable in-house counsel to manage the creation and communication of potentially privileged material.

Speakers
George Lukic is a Partner at Thomson Geer, and a skilled commercial litigator. He regularly deals with questions of legal professional privilege on behalf of in-house clients.
Damian Fitzgerald is the General Counsel of Viterra. He is a highly experienced in-house lawyer with experience in managing legal professional privilege as it applies to in-house lawyers.
