ACC AustraliaThere’s significant reform on the horizon for Australia’s privacy laws. Recent high-profile data breaches have put data protection under a microscope and put a fire under the Attorney-General’s ongoing review of the Privacy Act 1988 (Cth). Organisations today face increasing pressure from regulators and the marketplace to improve how they collect, use, store and delete personal information, and how they manage data privacy.
This session, hosted by Gilbert + Tobin’s Tech + IP team in conjunction with ACC Australia, will cover:
- a (brief) history of privacy law and global enforcement trends;
- major privacy trends in Australia, including data breach class actions, recent enforcement actions for facial recognition technologies and the regulator pile-on to privacy;
- the December 2022 amendments to the Privacy Act, including the new penalties regime; and
- the current privacy reform process in Australia and a rundown of key proposals raised in the Attorney-General’s review of the Privacy Act.

Speakers
Melissa Fai, Partner, Gilbert + Tobin
Melissa is a cyber security, data and privacy specialist who dedicates a significant part of her practice to advising Australia’s leading corporates on cyber security, privacy and data protection obligations in light of how clients use technology and data in their operations and transactions. She advises on complex issues surrounding cyber and data breaches and assists clients to understand their regulatory obligations under the mandatory notifiable data breach regime.
Claire Harris, Senior Lawyer, Gilbert + Tobin
Claire Harris is a senior lawyer who specialises in IT and telecommunications contracting, privacy and cybersecurity. She has been following the Attorney-General’s Privacy Act reform process very closely and has been a key contributor to Gilbert + Tobin’s Privacy Law Reform Series and its March 2023 submission to the Attorney-General. Claire’s background in electrical engineering and computer systems helps her to understand the technology underpinning her clients’ projects.
