Program Description:
Organizations are urgently adopting Artificial Intelligence (AI) in all facets of their business. This will enable organizations to do more in a shorter amount of time, which also likely means more contracts, more compliance obligations, and more disputes. In-house counsel will need to leverage AI tools to keep up – using these tools to draft briefs, review contracts, respond to emails, and so on. Despite these changes in technology, the central role of ethics remains a constant. In this presentation, we will discuss the exciting possibilities that AI brings to the legal profession, while explaining how the Rules of Professional Conduct are as relevant as ever. We will then discuss how AI governance can help legal departments – as well as organizations as a whole – to better use AI in an ethical and responsible manner.
Topics Include:
- Background on AI – what it is, why it is important, and how it promises to revolutionize the legal practice (10 minutes)
- Ethical issues for using AI in legal practice (20 minutes), including:
- Maintaining competence in use of new technologies (Model Rule 1.1, Comment 8)
- Managing workload and prompt responsiveness in the age of generative AI (Model Rule 1.3)
- Keeping your AI prompts secret -- attorney-client confidentiality (Model Rule 1.6) and privilege/work product issues when using generative AI
- Exercising care when using AI-generated content – the duty of candor (Model 3.3)
- Avoiding unauthorized practice of law (Model Rule 5.5)
- AI governance (20 minutes)
- Oversight
- Developing policies and procedures to prevent misuse of AI (for legal departments and, more broadly, for the company)
- Training and awareness
- Contracts with vendors
- Questions and answers (10 minutes)
