In this session, Clayton Utz Partners, Liz Humphry and Lucy Shea, together with special guest panellist, Phil McKeiver, GC of FFI, will discuss the latest developments and trends in ESG risk and risk management, including the evolving regulatory landscape, climate change litigation here and overseas, regulator and societal expectations, and practical implications for business.

Lucy Shea

Lucy Shea, Partner at Clayton Utz

Lucy Shea specialises in environmental, planning and climate change law. She has built a reputation as a go-to adviser to clients – in industry sectors spanning energy and resources and property, to infrastructure and agribusiness – who need clear and concise whole-of-project-cycle advice which balances environmental sustainability with their commercial outcomes.

Her work includes:

  • project establishment: risk assessment, approval and regulatory frameworks, environmental and planning approvals and appeals, compulsory acquisition, Native Title and Indigenous cultural heritage, water and biodiversity;
  • ongoing compliance: project expansion, contaminated land and remediation, emission reporting, environmental incidents and regulatory investigations;
  • litigation: planning appeals, environmental litigation and prosecutions and judicial review.

And with ESG standards ever-evolving, Lucy understands what's needed to make a development sustainable, and manage the risks – while seizing the opportunities – in Environmental, Social and Governance.
 

Liz Humphry

Liz Humphry, Partner at Clayton Utz

Liz Humphry has a diverse skill set, practising in commercial and corporate law with a particular focus on the energy and resources industry.
She has acted for a wide range of leading Australian and international organisations with regard to mergers and acquisitions, corporate finance/equity capital transactions, business structuring, projects and operational matters and Australian regulatory compliance issues.
With a strong client focus, Liz works with clients on complex legal matters to achieve robust commercial outcomes and specialises in advising boards and senior management on their activities in Australia and overseas.
Liz is a member of the Clayton Utz national board.
Liz is also the co-chair of our LGBTI program.
 

Phil McKeiver

Phil McKeiver, General Counsel, FFI

Phil is an experienced corporate and projects lawyer who starts with his client’s desired commercial outcome first then works through the legal hurdles to clear them away. He has extensive experience implementing deals and projects, and managing stakeholders and risk, across many sectors (energy, resources, power/renewables, water, transport, social infrastructure, real estate, telco, defence, agriculture etc.).

Not just an advisor, he has also served on many company boards and executive committees (including as Chairperson) and has more than 10 years of in-house experience in senior legal, managerial and company secretarial roles.

Phil has lived, worked and studied in the UK, and has lived and worked in several states throughout Australia. His expertise has seen him complete deals and projects across Australia, Asia, Africa, the Middle East and Europe. Phil has particularly deep experience with Japanese and Chinese parties and investors and he is also experienced in project development, compliance, dispute resolution, government relations and corporate affairs.
