ACC Australia and Gadens welcome you to attend a webinar on the recent changes to the unfair contract terms regime, which will have a significant impact on the way businesses contract with other parties. This session will provide you with an overview of the upcoming changes and provide practical commercial guidance for legal counsels to mitigate risks within their businesses. 

Hosted by Adam Walker (Partner), Eve Lillas (Senior Associate) and Joseph Abi-Hanna (Senior Associate) from Gadens, the presentation will focus on:

  • a recap of the unfair contract terms regime;
  • an overview of the amendments to the unfair contract terms regime, which come into effect on 10 November 2023;
  • enforcement trends in relation to contraventions of the unfair contract term regimes;
  • top 'unfair' terms to look out for;
  • examples of how to amend terms that may be considered unfair; and
  • practical tips and takeaways for legal counsels.

The session will include an opportunity for attendees to ask questions of the Gadens' team.


Speakers

Adam Walker

Adam Walker, Partner, Gadens

Adam Walker is a Partner at Australian law firm Gadens specialising in the fields of competition and consumer law, franchising, energy, and complex regulatory and compliance matters. Adam’s experience includes advising clients, including ASX-listed corporations, on questions of competition law, including: cartel conduct; substantially lessening competition (in respect of both vertical arrangements and acquisitions); restraint of trade matters; third line forcing; and misuse of market power; and representing clients in ACCC investigations, merger clearance matters and notification filings.

He also acts for national franchisors in all aspects of their business, including documentation, Code compliance, supply arrangements, third line forcing, corporate structuring, IP protection, leasing, and dispute resolution.

Over many years, Adam has advised clients across a range of industries on compliance with the law related to unfair contact terms. 
 

Eve Lillas

Eve Lillas, Senior Associate, Gadens 

Eve Lillas is a Senior Associate at Australian law firm Gadens specialising in commercial contracting, consumer law, technology law, privacy law, media and advertising and intellectual property.  Eve has also worked as in house legal counsel in London at a global media and advertising agency.

Eve's experience including drafting and negotiating a range of commercial agreements (including services agreement and IT contracts and procurement) and advising on compliance with the Australian Privacy Laws and consumer law. 

Eve is a member of Gadens' unfair contract terms working group and has assisted clients to review and amend potentially unfair terms in their standard form contract and to implement risk mitigation strategies. 
 

Joseph Abi-Hanna

Joseph Abi-Hanna, Senior Associate, Gadens

Joseph Abi-Hanna is a Senior Associate in the Intellectual Property and Technology team at Australian law firm Gadens. Joseph has a broad range of experience in consumer, marketing/trade promotions, technology, privacy, health sciences and general commercial law. 

He advises national and multinational businesses on marketing and promotional activities, the Australian Consumer Law and privacy law. Joseph has a keen focus on regulated industries, including the FMCG, technology, therapeutic goods and gambling industries. His experience with commercial contracts and customer-facing terms and conditions sparked his interest in unfair contract terms.

Joseph is a member of Gadens' unfair contract terms working group. He assists various clients to navigate the unfair contract terms regime and offers pragmatic advice on reducing their risk exposure under the regime.
