The Hybrid Role of In-House Counsel and Protecting Privilege
In-house counsel frequently serve multiple roles for their companies, providing both legal advice and business advice. Wearing multiple hats has important implications for the attorney-client privilege. Where an attorney’s presence in a meeting blurs the distinction between various roles, the confidentiality associated with attorney-client privilege can also be blurred. This session will explore best practices for in-house counsel assuming various roles.
Unauthorized Practice of Law
Many companies have offices in several states or countries. Some states have special exceptions for in-house lawyers that allow them to bypass special admission into the states when acting as in-house counsel. Other states do not have such an exception. ABA rules provide some guidance on how to navigate providing legal advice in multiple jurisdictions while ensuring compliance with applicable professional conduct rules.
