The Pregnant Workers Fairness Act
The Pregnant Workers Fairness Act (PWFA) requires employers to provide reasonable accommodations to employees experiencing limitations relating to pregnancy, childbirth, and related conditions. The law has been interpreted very broadly to apply to all aspects of pregnancy including fertility, miscarriage, abortion, and lactation. The law applies to public and private employers with 15 or more employees, so many companies are impacted. The PWFA just took effect in mid-2023 and the EEOC issued its final regulation interpreting and offering guidance on how the law will be enforced in 2024. Additionally, the EEOC has now begun filing lawsuits against employers for violations of the PWFA.
