iii. AI Generated IP - Is it an Oxymoron? Understanding Ownership and Liabilities Associated with AI Created Works (Mini Session 3)

This presentation discusses whether or not AI-generated works can be "owned" for purposes of IP protection. This issue is being heavily argued in the federal courts currently. Potential opportunities and issues associated with licensing creative works for use in training or teaching AI models will also be discussed.

Discussion of how the False Claims Act (FCA) is being used by private litigants, including employees, and by the government to seek millions in damages against government contractors and healthcare entities for failing to meet government cybersecurity standards. Topics include a background of the FCA, federal cybersecurity enforcement practices, whistleblowers profiles, and lessons-learned from recent FCA cyber cases.

AI tools are becoming more prevalent in the legal profession, and have the potential to improve how lawyers deliver legal services. But the use of AI tools also comes with risks, including generative AI's well-documented propensity to hallucinate or to introduce or exacerbate existing bias, and introduces potential ethical concerns in the legal profession. This panel focuses on understanding ethical considerations when using AI for legal work and highlights recent case studies.

Emily Apte, Counsel, King & Spalding LLP
Kassi Burns, King & Spalding LLP, is a Senior Attorney with over 10 years of experience working with AI and Machine Learning in litigation and investigations. In addition to a growing collection of publications on topics related to AI, Kassi is actively engaged in thought leadership through her podcast Kassi &, focused on the impact of emerging technologies to our professional and personal lives. Kassi is a board member of the Academy of Court-Appointed Neutrals, a member of the Sedona Conference Working Group 13 (AI & the Law) Steering Committee, Texas Regional Chair of Women in AI Governance, a Fellow of the American Bar Foundation, and Secretary of the State Bar of Texas Legal Practice Management Committee.
Alex Davey is a Senior Associate with the Special Matters and Government Investigations practice group at King & Spalding LLP in Houston, Texas, with a broad experience of investigations, combined with experience counseling clients on expanding legal risks caused by cybercrime. Alex represents clients facing a wide range of cyber threats, and recently spent a year seconded to a large technology company where he advised the companies varied business units on cybersecurity risks. Alex is well attuned to the challenges clients face resolving cyber threats, addressing cybersecurity compliance requirements, and responding to resulting questions from government agencies.
Michael Galdo is a Counsel with the Special Matters and Government Investigations practice group at King & Spalding LLP in Austin, Texas, focusing on complex investigations, expecially those with cyber, transnational, or national security implications. Mr. Galdo served for over 15 years as a federal prosecutor, including as the Assistant United States Attorney in Charge of Cybercrime for the Western District of Texas, leading investigations into malware distributors, business email compromise schemes, and other cybercrime offenses. Mr. Galdo also spent nearly a decade as a national security prosecutor, investigating and charging export control violations for the unlawful export of sensitive technology, espionage, and terrorism offenses.
Sheri Hunter is a Counsel with the Intellectual Property practice at King & Spalding LLP in Austin, Texas. Sheri focuses on U.S. trademark and copyright law. She has extensive experience counseling clients in the areas of trademark, copyright, sweepstakes and contests, licensing, advertising, and marketing content.

Rachel Zaldivar Johnson is a Senior Associate on the Data, Privacy & Security Team at King & Spalding LLP in Washington, D.C. Rachel is well-versed in federal and state data privacy laws, and regularly advises clients on the development of data privacy and security programs, data protection and security strategies, cross-border data transfers, regulatory enforcement investigations, AI/ML governance, and the privacy aspects of M&A transactions.
