This article provides an overview of a particular legal challenge that has come about due to the COVID-19 pandemic, namely remote alternative dispute resolution. The alternative had a boost in popularity following the pandemic, and while there are a number of difficulties involved (technicalities and logistics), it has been shown that remote arbitration and mediation may also facilitate timely dispute resolutions in a flexible and cost-effective manner.
The article also provides a sample contract clause of expressly defined supplemental terms in order for the alternative dispute resolution can occur with explicit guidelines and a mutual understanding between the parties.
