On March 11, 2013, the Supreme Judicial Court of Massachusetts held that collecting a consumer’s ZIP code during a credit card transaction may violate Massachusetts General Laws Chapter 93, Section 105(a) (“Privacy Statute”), 2which prohibits merchants from collecting personal identification information when processing card transactions. The decision may result in increased privacy class actions against retailers in Massachusetts and other states with laws restricting the type of information merchants can collect from consumers.
