Fair use is one of the trickiest and most litigated issues facing copyright and trademark practitioners, particularly in connection with movies, television, and games. When clearing titles and content, one must increasingly consider whether and to what extent one can use or reference another’s brand or creative works.  Join Cooley attorneys Bobby Ghajar and Marcus Peterson for a discussion of the issue with a summary of the current state of copyright fair use law including a discussion of the recent Supreme Court Oracle v. Google decision and the 2nd Circuit Warhol decision that limited the prior Cariou case dealing with use of another’s copyrighted photographs.  We will also discuss both “classic” and “nominative” trademark fair use, and test your understanding with a quick game of fact or fiction based on some (at times, surprising) real-world examples.

Ethereum and Smart Contracts  - Programmable blockchain that allows developers to build applications on top of the blockchain. - E.g. can program a legal contract or financial transaction into a smart contract. - Ethereum is what made Crypto what it is today. People have now used this programming framework to create all kinds of new cryptos and artificial money for whichever use case they want. (Will bring in examples of how this will be and already is being used in sports/ entertainment industry later)

 

NFTs ( - Discuss what NFTs are and why they have become so popular in the sports/entertainment space. - Brief discussion about continuous innovation of NFTs - Traditional top-down approach vs. new bottom-up approach (new as in less than a month old).

 

Effects on Sports and Entertainment Industries  - Raising money via Crypto for teams, athletes, celebrities, etc. - Teams creating tokens for special deals and potentially ownership stake in team. - NFL players negotiating contracts to be paid in Crypto - Eventually contracts will be in the form of NFTs on the blockchain and money will be automatically distributed and all incentives/bonuses can be programmed into the smart contract. - NFTs as collectibles (NBA Top Shot/MLB Baseball game) - Discuss top down approach (Larva Labs/United Talent Agency partnership) vs. new bottom up approach and how it relates to sports.
