Historically, India was seen as a problematic jurisdiction as regards enforcement of foreign awards, even though it ratified the 1958 New York Convention in 1960. Over the past few years, however, through legislation and judicial decisions, including the 2015 amendments to the Arbitration and Conciliation Act, 1996, India has come more in line with other countries in this respect, and this has eased the process of enforcement of foreign awards in India. This workshop / lecture discusses some hurdles and strategies for enforcement of foreign awards in India, including issues you can proactively address in your contracts with Indian entities.
