Emerging Data and Off-Channel Communications Under Regulatory Scrutiny

A broad cross-section of regulatory activity underscores just how valuable and risky data has become in the current business environment. More pointedly, scrutiny over “off-channel communications,” or “emerging data sources,” such as modern communications tools, collaboration platforms, personal devices and chat applications, is intensifying worldwide. THE PFAS AND THE FURIOUS: MINNESOTA’S BURGEONING PFAS REGULATORY ENVIRONMENT (AND ITS POTENTIAL EFFECTS ON YOUR COMPANY)

Minnesota is at the forefront of states that have adopted laws regulating, restricting or prohibiting per- and polyfluoroalkyl substances (PFAS) in a wide variety of products and packaging materials. At the same time, the Minnesota Pollution Control Agency has adopted a “PFAS Blueprint” that, among other things, set in motion requirements and guidance for hundreds of companies to test their air emissions, industrial stormwater and wastewater discharges, or solid and hazardous wastes for the presence of PFAS and to assess, investigate, and potentially, remediate PFAS contamination at certain sites involved in the Remediation program. In this presentation, we will provide an overview of these regulatory efforts, discuss the challenges other states and the businesses within them have faced in undertaking similar efforts, and offer suggestions on how you can help your company prepare for the road ahead.
