Despite concerns early in 2020 that the pandemic would impact the growth of environmental, social, and governance (ESG) initiatives, the opposite proved to be the case with political and investor momentum aligning and ESG initiatives surging in the climate of “building back better”. The webinar will also analyze the outlook for environmental litigation under the Biden administration and review recent decisions and cases to watch on the Supreme Court docket.

Under California's Safe Drinking Water and Toxic Enforcement Act of 1986, more commonly known as “Proposition 65,” businesses must not knowingly or intentionally expose people to chemicals known to the State of California to cause cancer or reproductive harm without a prior "Clear and Reasonable Warning." We will provide a general overview of the "Clear and Reasonable Warning" requirements, and discuss some common compliance pitfalls and potential regulatory changes, including those related to “short-form warnings,” on which the regulated community heavily relies, and acrylamide regulation.
