Intellectual Property (IP) is a longstanding, critical concern for companies operating in China, where trademark piracy and counterfeiting are rampant. Given that, IP enforcement in the PRC has been and remains key to any company’s strategies and operations.
While China has made significant strides in its IP laws over the last 30 years, deficiencies remain in those laws, and in particular, the enforcement of those laws. This is due in part to protectionist policies, as well as to the sheer scale of the problem, with the proliferation of fakes online being a particularly hard-to-crack problem.
With that background, the speakers will provide an update on recent IP legislation covering trademarks, patents and trade secrets; an overview of the IP provisions in the recent US-China trade agreement; developments in day-to-day enforcement, including online; and best practices in protecting IP rights of SMEs.

Joe Simone, Partner, SIPS Joe Simone is the founder and a partner with SIPS, a firm focused mainly on the protection of IP rights in Greater China, including the PRC, the Hong Kong SAR and the Taiwan region. Joe has advised companies on the protection of their IP rights in Greater China since the mid-1980s. He is also a UDRP arbitrator handling domain name disputes under WIPO. Joe publishes frequently on IP topics in China and contributes regularly to position papers on legislative reforms issued by trade groups and professional associations. |
