Digital communications and electronically stored data come with inherent vulnerabilities and the potential for employer liability. Harnessing the power of the digital age while controlling workplace risks is a challenge. The notion of electronic communications and social media in the workplace has changed drastically over the past decade, morphing from activities employers often sought to limit to required activities of one’s job in many occupations, including those that will help grow the business. This InfoPAK covers laws impacting privacy and data security and best practices for reducing workplace information risk. It also discusses the particular benefits and risks of the company’s use of social media and social networking technologies. Finally, it looks at the issues in employment litigation arising out of digital information and communications.

Over the past several years, using patents to protect innovation has become increasingly complicated as technology itself has exploded in sophistication and complexity. This is especially true in the realm of software. In the United States, patents are currently being used as both swords and shields in attacks on software innovation. As noted in a recent New York Times article, “there is a widespread belief that software and algorithms that rely on data are objective. But, software is not free of human influence. Algorithms are written and maintained by people, and machine-learning algorithms adjust what they do based on people’s behavior.” In an era where big data is used for decision-making purposes, the legal profession grapples with possible hidden bias and the need for greater transparency in the use of black-box algorithms. This session will explore data ethics and the need for its inclusion in information governance conversations within corporations as entities collect, use, and monetize client data. The session will explore C-suite transparency in connection with software used for insider threat monitoring and surveillance, making hiring decisions, and monitoring various forms of employee behavior.

Social media is a “hot topic.” It seems that everyone has an opinion on how to navigate this dynamic intersection of law and technology — including our regulators. It’s one thing to mitigate the risks, but it’s another to do so without alienating your workforce ... or your CEO. These advances in technology heighten threats to employers'' trade secrets, and other confidential and proprietary information. Coping with these realities is not made easier by laws that have not kept up with how people use technology in their private and working lives. In addition, emerging ethical traps, including enhanced employee privacy protections, ensnare employers and their attorneys as they attempt to deal with technology and employment-related issues. We’ll break through the noise and tell you what you really need to know as corporate counsel to keep your company compliant without getting in the way of business.
