The Singapore International Arbitration Centre (SIAC) published statistics regarding the use of its emergency arbitrator provisions. These show a record number of emergency arbitration applications received by the SIAC in the last year, in an increasingly broad range of sectors. Overall, the SIAC has handled 34 emergency arbitrations since this procedure was introduced in July 2010. Asia accounts for an increasing share of global trade and foreign investment as the region continues to thrive. These trade flows and investment activities have seen a consequent need for appropriate dispute resolution mechanisms. This session will look at litigation and arbitration in the Asia region, with a particular focus on the main dispute resolution centers of Hong Kong and Singapore, and will assess the practical strengths and weaknesses of various mechanisms, including the enforceability of judgments and awards. Case studies will assist in emphasizing certain key points – what works and what doesn’t, and why. Suggested sample wording for dispute resolution and governing law provisions in contracts will also be covered.
