The Ongoing Challenge of Global Privacy and Cybersecurity Compliance Mark Vitek (not verified)
On-Demand

The GDPR was enacted more than 5 years ago, but global companies continue to grapple with privacy laws throughout the world, now with even more cybersecurity laws and regulations set to take effect. Beginning with a panel discussion, this session will compare existing US and EU data privacy laws with China's new Personal Information Protection Law (PIPL) before attendees step in to discuss how data privacy scenarios should be handled under both existing and future laws. The session will integrate insights for crafting a flexible and effective global cybersecurity compliance policy, examine international perspectives on cybersecurity obligations, and identify overlaps in cybersecurity and data privacy.

"Endeavours" clauses, whether described as "all reasonable endeavours", "best endeavours" or "reasonable endeavours", have resisted a fixed definition in case law: their meanings are derived from the context of the relevant contract, rather than from decisions in previous cases. However, recent case law from Singapore and Australia has provided some general guidance on the interpretation of such clauses. This article examines these decisions and provides some practical tips for drafting such clauses.

The Singapore International Arbitration Centre (SIAC) published statistics regarding the use of its emergency arbitrator provisions. These show a record number of emergency arbitration applications received by the SIAC in the last year, in an increasingly broad range of sectors. Overall, the SIAC has handled 34 emergency arbitrations since this procedure was introduced in July 2010. It is a system that has been proven to work well, in itself; but there remain issues with emergency arbitration, particularly in the enforceability of emergency arbitration awards, as Ben Giaretta and Michael Weatherley explain.

Asia accounts for an increasing share of global trade and foreign investment as the region continues to thrive. These trade flows and investment activities have seen a consequent need for appropriate dispute resolution mechanisms. This session will look at litigation and arbitration in the Asia region, with a particular focus on the main dispute resolution centers of Hong Kong and Singapore, and will assess the practical strengths and weaknesses of various mechanisms, including the enforceability of judgments and awards. Case studies will assist in emphasizing certain key points – what works and what doesn’t, and why. Suggested sample wording for dispute resolution and governing law provisions in contracts will also be covered.

This interactive session will demonstrate how corporate counsel should react when their organization is hit with major litigation, including a governmental investigation targeting directors and officers. Attendees will participate in a “What should you do next?” discussion using electronic voting and Q&A throughout the session. By walking through the phases of a crisis as it typically unfolds, the panel will cover critical issues such as formation of special board committees, internal investigations, government disclosure, media strategy, hiring outside counsel, directors and officers (D&O) insurance and indemnification rights, attorney–client privilege concerns and must-know areas of D&O liability exposure. Special focus will be given to corporations with a global footprint that face exposure across international lines. The panel will use sample cases pulled from recent headlines, including insider trading investigations; cases involving the Foreign Corrupt Practices Act; whistleblower cases and cases involving faulty accounting and disclosure allegations.

1 January 2014 saw the implementation of Basel III in the European Union (EU) via the Capital Requirements Directive IV (CRD IV) and the Capital Requirements Regulation (CRR). These twin pieces of regulatory reform represent the biggest change to capital requirements for financial institutions since the financial crisis. The combined reforms introduce new capital, leverage and liquidity requirements, whilst also introducing new concepts such as capital buffers and imposing regulatory frameworks on securitisations, derivatives trading and remuneration policies. Read this series of briefing papers on the impact of CRD IV and the CRR.
