INTRODUCTION:

The evolution of international commercial courts is fast reshaping the dispute resolution landscape. Established nearly a decade ago, the Singapore International Commercial Court (“SICC”) offers a neutral forum for resolving cross-border commercial disputes merging the flexibility offered by alternative dispute resolution mechanisms with the powers of a court. Practitioners and parties will benefit from understanding SICC’s working, jurisdiction, international flavour, the enforceability of its judgments and the tools it has introduced such as the SICC Model Clause and the Lit-Med-Lit Protocol.

In fact, last month, the SICC (International Committee) Bill was introduced in the Singaporean Parliament, which proposes the establishment of an International Committee of the SICC. The Committee is intended to serve as a transnational court of appeal for civil matters from foreign jurisdictions. The enactment and implementation of the Bill not only has the potential to strengthen Singapore as a hub for international commercial dispute resolution but also allow other jurisdictions to provide parties access to a transnational court and efficacious dispute resolution at the appeal stage.

In light of such rapid developments and their potential benefits, it is essential to understand more about the SICC, its unique features, and how parties and their counsel can use it advantageously to ensure effective and commercially sound dispute resolution.
