Big Data and artificial intelligence (AI) are increasingly playing an important role in driving innovation in practically all commercial and non-commercial aspects. Given the significant investments businesses are making into developing AI systems and collection of data, it is important for in-house counsel to implement a proactive and competitive strategy to protect IP rights in AI as well as the collected data. There is a reciprocal relationship between AI and big data because the success of AI depends heavily on big data while AI helps unlock the potential of large amounts of data by providing new processing tools, and any IP protection strategy should consider this relationship. The CLE will consider not only patent coverage, but also copyright protection, trade secret protection, and contractual provisions for protection of big data and AI – within U.S. as well as international jurisdictions.

Since the Me-Too era in 2017, internal investigations have become of greater significance ot company Boards and senior management.  This presentation will discuss these changes and include an overview of the role of in-house counsel and attorney client privilege.

Many in-house legal teams struggle with the vast quantities of paperwork and electronic data that needs to be managed and stored. Lawyers need to understand what information assets they have and how this is classified, retained, and managed over its lifecycle.

In this program, our panellists will discuss their experiences with implementing document retention policies, how to ensure your policy complies with applicable laws, best practices to help you create more efficient document and data retention processes and what can go wrong when you don’t have a policy.

Panellists:

  • Tiana Van Dyk, Senior Director Client Services and Document Review, Epiq (Moderator)
  • Lindsay Holland, In-house Counsel and Corporate Secretary, British Columbia Investment Management Corporation
  • Patricia Osoko, Senior Advisor, Simplex Legal LLP
  • Julie Colgan, Vice President, Global Business Transformation Solutions, Epiq

Join us for our March Platinum CLE: “Do This, Not That.  How to (Better) Protect Privilege in Your Electronic Documents”.  Presented by Platinum Sponsor, Laffey, Leitner & Goode LLC.

Lawyers are ofter analog creatures living in a digital world. But sometimes, when it comes to privilege, the ease of sharing information digitally makes protecting the privilege that much harder. In this presentation, we will help guide you through the changing landscape of the attorney-client privilege and the attorney work-product doctrine and how the Courts have recently started applying these doctrines to in-house lawyers and their internal clients - often resulting in unintended consequences and a finding of waiver of privilege.  After this presentation, we hope you will be armed with more tools in your toolbox to assist  you in protecting your client's sensitive information, your legal analysis and your work product from disclosure- regardless of whether you are anticipating litigation.
