On 29 January 2024, the Mainland Judgments in Civil and Commercial Matters (Reciprocal Enforcement) Ordinance came into operation. This opened a new chapter in terms of mutual recognition of judgments between Mainland and Hong Kong SAR, and certain conditions need to be met for judgment creditors to seek to enforce Mainland Judgments in Hong Kong, and vice versa.

Join Jennifer Wu (Partner, Pinsent Masons) and Adrian Lai (Barrister, Des Voeux Chambers) for a 1-hour webinar to explore the changes in the reciprocal enforcement arrangements of Court judgments and arbitral awards, what is captured by the new reciprocal enforcement arrangement, what are the considerations for businesses and in-house counsel - particularly when dealing with contractual, operational and enforcement issues. Topics will include the Corporate Transparency Act, Texas Business Courts, the FTC’s non-competition ban, and forfeiture for competition provisions. Amy and Anesha will share model language to address these developments and answer frequently asked questions.

ACC Northeast and Pierce Atwood are pleased to present our next partnered webinar to dive into Artificial Intelligence (AI) solutions.

In-house counsel must understand the legal risk of new-to-market AI solutions.  Using a real-world hypothetical, Pierce Atwood attorneys Tim Fisher, Vivek Rao and Ariel Pardee will present a contract negotiation between an AI technology supplier and its consumer-facing enterprise customer.  We will describe the preferred first positions each side is likely to put forward on topics such as:

  • Infringement;
  • Representations and warranties (including with respect to explainability, bias, transparency, accuracy, and privacy);
  • Ongoing model risk management and governance.

We will then discuss how, during counter, in-house counsel can unpack the AI solution’s design to unlock more nuanced approaches to these topics and avoid negotiation stalemates.

Business & Commercial Litigation Update: The program focuses on recent Nevada Supreme Court decisions that provide guidance to in-house counsel on key substantive and procedural issues involved in a variety of business and commercial litigation matters. A few examples of the cases and issues that will be covered include (1) offers of judgment that are inclusive or exclusive of costs, expenses, interest, and attorney fees, (2) modifiable and unconscionable noncompete provisions, (3) foreseeability and the traveling employee rule in workers’ compensation benefits, (4) breach of contract claims and interpretation issues involving ambiguity in payment terms and novation vs. modification, and (5) no signatory consent to arbitration. The program is designed to provide in-house practitioners with legal insights, litigation strategies, and practical approaches to business and commercial litigation.
