  Program Description:

Organizations are urgently adopting Artificial Intelligence (AI) in all facets of their business.  This will enable organizations to do more in a shorter amount of time, which also likely means more contracts, more compliance obligations, and more disputes.  In-house counsel will need to leverage AI tools to keep up – using these tools to draft briefs, review contracts, respond to emails, and so on.  Despite these changes in technology, the central role of ethics remains a constant.  In this presentation, we will discuss the exciting possibilities that AI brings to the legal profession, while explaining how the Rules of Professional Conduct are as relevant as ever.  We will then discuss how AI governance can help legal departments – as well as organizations as a whole – to better use AI in an ethical and responsible manner.

 Topics Include:

  • Background on AI – what it is, why it is important, and how it promises to revolutionize the legal practice (10 minutes)
  • Ethical issues for using AI in legal practice (20 minutes), including: 
    • Maintaining competence in use of new technologies (Model Rule 1.1, Comment 8)
    • Managing workload and prompt responsiveness in the age of generative AI (Model Rule 1.3)
    • Keeping your AI prompts secret -- attorney-client confidentiality (Model Rule 1.6) and privilege/work product issues when using generative AI
    • Exercising care when using AI-generated content – the duty of candor (Model 3.3)
    • Avoiding unauthorized practice of law (Model Rule 5.5)
  • AI governance (20 minutes)
    • Oversight
    • Developing policies and procedures to prevent misuse of AI (for legal departments and, more broadly, for the company)
    • Training and awareness
    • Contracts with vendors
  • Questions and answers (10 minutes)

Presentation Description: Join us for a fun, but informative, CLE ethics seminar in the format of a panel game show. Contestants answer and discuss legal ethics questions, hypotheticals and dilemmas posed by our Legal Ethics Hosts, who will involve the audience in competition with the panel as well as lively discussion on current legal ethics issues and rules of professional practice. Contestants and the audience may be asked to select the true ethics story from among fictional hypotheticals, guess the ending to bizarre ethics sagas provide the final lines of a poem that describes an ethics controversy or simply answer a traditional true/false or multiple-choice questions.  Discussion will follow each question wherein the Legal Ethics Hosts will provide references to relevant rules, cases and ethics opinions.
