Each year, numerous companies operating in California find themselves defending against high-stakes class action litigation—including lawsuits alleging damages from data breaches, products liabilities, wage-hour and other employment violations, and invasions of privacy.  For insured companies facing such claims, liability insurance policies can help defray much or all of the expense associated with defending and resolving such claims.

In this presentation, insurance recovery partners from Pasich LLP will focus on ways in which companies can maximize their coverage for class action lawsuits and maximize the value of their liability insurance policies. Among other topics, our speakers will address notice and reporting requirements, the satisfaction of deductibles and retentions in the class action context, disputes concerning the selection of defense counsel, insurance coverage for class action settlements, and the evaluation of third-party indemnity agreements.  In addition to addressing insurance coverage for a wide range of common law class action theories, the speakers will also discuss coverage for some of the most common statutory class action claims filed against California companies, such as those alleging violations of the California Labor Code and Private Attorneys’ General Act (PAGA), the Biometric Information Privacy Act (BIPA), the California Invasion of Privacy Act (CIPA), the California Consumer Privacy Act (CCPA), and California’s Unfair Competition Law (“UCL”), among others.

Business & Commercial Litigation Update: The program focuses on recent Nevada Supreme Court decisions that provide guidance to in-house counsel on key substantive and procedural issues involved in a variety of business and commercial litigation matters. A few examples of the cases and issues that will be covered include (1) offers of judgment that are inclusive or exclusive of costs, expenses, interest, and attorney fees, (2) modifiable and unconscionable noncompete provisions, (3) foreseeability and the traveling employee rule in workers’ compensation benefits, (4) breach of contract claims and interpretation issues involving ambiguity in payment terms and novation vs. modification, and (5) no signatory consent to arbitration. The program is designed to provide in-house practitioners with legal insights, litigation strategies, and practical approaches to business and commercial litigation.

Presenters are McDonald Carano attorneys, Chelsea Latino and Phil Mannelly.
