The role of in-house counsel in India is evolving rapidly, and the influence of legal over other departments is also growing. Indian corporate counsel must prepare themselves for compliance in multiple jurisdictions and be aware of the legal and ethical environs of the countries in which they are doing business.
Creating and implementing a compliance program can seem like a looming prospect for any small legal department. However, don’t get intimidated by the process. By following the “10 Hallmarks for a Successful Compliance Program,” in-house counsel can implement a system that effectively safeguards against compliance risk, without breaking the budget in the process.
Contract boilerplate - choice-of-law, forum selection, integration, severability and survival clauses - are standard and necessary provisions in employment agreements. These clauses are so common that they're often recycled from one agreement to the next - sometimes with just a few keyboard clicks. But beware: Dangers may be lurking in these commonly used provisions.

This program will review lessons learned in international litigation and alternative dispute resolution (ADR) with a focus on Mexico. Most multinational corporations now have significant operations located in Mexico and, despite the business’s best efforts, may unfortunately find themselves embroiled in a legal dispute there. We will review the applicable legal recommendations for arbitration, mediation and litigation, including issues such as law firm selection, supervision of Mexican litigation, expected time frames for resolution, discovery, substantive and procedural concerns, institutional arbitration options, enforcement issues, etc. In-house counsel with experience in Mexican disputes will offer their insights and recommendations based on their experiences in-country.
Join us on January 29, 2025. All in-house counsel are welcome.

When Good Enough Isn’t Good Enough - Perfectionism in the Legal Profession
(1.0 Hour Competence Issues Credit)
“Everyone tells me I’m doing a great job. My clients, my colleagues, my family. Why do I feel like I don’t measure up- that my work just isn’t that good?”
“If I ask for help, everyone will know the truth about me.”
“I’m ok. I can work this out for myself.”
Sound familiar? If so, you may be struggling with the perfectionism and self- doubt that has plagued members of the legal profession for years. When the pressure placed on lawyers externally to succeed is outweighed by the pressure lawyers place upon themselves, the impact on mental health can be devastating if left untreated.
There is a misconception among lawyers that only people who have “hit bottom” need or ask for help. The statistics say otherwise as recent surveys indicate that the overwhelming majority of legal practitioners believe they have suffered negative mental health consequences as a result of their chosen profession.
Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession. The statistics are compelling and clearly indicate that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers.

Why Civility Matters
(1.0 Hour Civility Credit)
This program will explore what civility is and why it is so important to the legal profession and the courts. We will examine the recent report and recommendations of the California Civility Task Force (“CCTF”), a joint project of the California Judges Association and the California Lawyers Association chaired by Justice Brian S. Curry, Presiding Justice of the Second District Court of Appeal, Division Four. We will delve into – in the words of the CCTF’s report – the link between incivility and bias where “young lawyers, women and those from historically underrepresented communities are disproportionately on the receiving end of intemperate remarks and abusive behavior.” This program will offer practical strategies for identifying, preventing and addressing incivility.

Net zero and ESG commitments are on the rise as they are key for companies who wish to credibly display their sustainability ambitions. By doing so, companies come under the scrutiny of regulators, NGOs and citizens and greenwashing concerns are easily raised. In this session, we will talk about the impact of sustainability commitments from a disclosure and reporting standpoint but also how you, as an in-house counsel can act to drive net zero commitments.
