Join us on Thursday, October 24, 2024, for an insightful seminar on the nuances of ethical competence within New Hampshire’s professional conduct rules.

This program is an essential opportunity for in-house counsel to deepen their understanding of ethical responsibilities and stay ahead of the curve in a rapidly changing legal landscape.  Don’t miss out on this chance to enhance your understanding of technological competence under the ethics rules.

Key Topics:

  • Technical Competence: Learn what in-house counsel must do to ensure they meet the technical competence requirements for their clients.  Our speakers will provide practical advice and strategies to maintain and enhance your technical skills in an ever-evolving legal environment.
  • Organization as a Client: Understand the unique ethical obligations when representing an organization under the rules of professional conduct.  Our professional rules require that a lawyer representing an organization address violations of legal obligations by those within or to the organization under certain circumstances.  We will explore how to navigate these responsibilities, including when to refer matters to higher authorities within the organization and when a lawyer may reveal otherwise confidential information about the lawyer’s representation of the organization.
  • Practical Considerations: Gain valuable insights into the everyday ethical challenges faced by in-house counsel.  Our experienced speakers will share real-world examples and practical solutions to help you uphold the highest ethical standards in your role.
  • AI Policies: As artificial intelligence becomes increasingly integrated into legal practice, the need for robust AI policies is gaining critical importance.  Discover the ethical implications of AI in the legal field and learn how to develop and implement effective AI policies for your organization.

This in-person program will also provide a great networking opportunity to connect with your fellow in-house colleagues in New Hampshire!

The Department of Justice is intensifying its corporate enforcement efforts with a new whistleblower program that will likely increase the number of whistleblower complaints DOJ receives. Under the Corporate Whistleblower Awards Pilot Program, a whistleblower who provides the Criminal Division with original and truthful information about corporate misconduct that results in a successful forfeiture may be eligible for an award. The program is intended to complement existing whistleblower programs, such as the program overseen by the Financial Crimes Enforcement Network for violations of U.S. sanctions and anti-money laundering violations. Beginning with this pilot program aimed at cases where whistleblowers are not already eligible for payments from other government programs, DOJ plans to pay whistleblowers from monies that defendants forfeit when they settle civil claims or are sentenced after a guilty plea or conviction.

Our presenters will review key strategies in-house counsel can implement to create effective compliance programs and an environment where employees feel safe and supported in reporting concerns internally. Based on extensive experience counseling clients through internal investigations and government enforcement actions, the presenters will discuss proactive measures that help companies identify, deter, and respond to potential misconduct early, thereby reducing the risk of external whistleblower actions in this new environment.

RSVP by 10/7/24 and please inform the host if you have any food allergies or dietary restrictions.

To prevent the misappropriation of trade secrets – whether when negotiating a joint venture or to prevent employees from leaving with sensitive information— it is essential to first identify the relevant trade secrets and take reasonable measures to protect them. Many companies try to protect their trade secrets after they have been shared with a third party, which is often much too late.  This session will provide an overview of trade secrets and practical steps companies should take to develop a plan for protecting these critical assets.

Presented by Brad Scheller, Member at Mintz, Chris Lin, Chief Administrative Officer & General Counsel of BlackSky, and Sumeet Magoon, Senior IP Counsel at Raytheon.

1.5 Hours of VA MCLE pending.

Dive into the digital deep end as we discuss how artificial intelligence is rewriting the rule book on intellectual property.  This Program brings together intellectual property lawyers from law firms and in-house legal teams to discuss these significant topics:

  • Ownership of IP created with AI – who is the inventor and who owns the output?
  • Infringement Risk Management – how do companies manage infringement risks and protect their IP when they use AI?  Does AI output infringe third party rights?  How to prevent AI systems from learning from and/or incorporating a company’s IP?
  • Integrating AI into the workplace – how to balance efficiencies with appropriate contractual and internal controls?  Protect trade secrets.  Protect privilege.

Co-sponsored by ACC Northeast and BIPLA, this Program will unpack how AI shakes up everything from trade secrets to copyright, and from IP ownership to privilege. The panel share strategies for shepherding your company’s IP rights while balancing the efficiency of technology with the need for appropriate controls.

Whether you spend time in the boardroom, at the negotiation table, or in a courtroom, you will gain crucial insights to stay a step ahead in the age of AI.
