Jones Day and the Association of Corporate Counsel - Western Pennsylvania Chapter invite you to join us for a timely and informative panel discussion at Jones Day's Pittsburgh Office.

Trade secret litigation and claims brought under the federal Defend Trade Secrets Act (DTSA) are on the rise, with several recent $100 million-plus verdicts being reported. This session will provide an update on key developments in federal DTSA cases and will focus on how in-house counsel can prepare now – before a dispute arises – to protect their companies' trade secrets, mitigate risks regarding trade secret disclosure and, if necessary, litigate trade secret disputes.

The panelists will provide an overview of DTSA and the Pennsylvania Uniform Trade Secrets Act, identify concrete steps company counsel can take to best position their clients for litigation success, and explain what in-house counsel can expect in these fast-moving cases.

Although there’s a time and a place to discuss more mundane concepts associated with properly classifying and compensating employees, this is not that time or place! This session will address some of the more challenging and unusual issues that arise under the Fair Labor Standards Act (FLSA) and state wage and hour laws. Topics to be addressed will include: remote worker issues, such as outside sales, travel time, on-call time, and reporting time; states that don’t recognize the typical federal exemptions; unusual FLSA exemptions; and other tricky wage and hour concepts. 

For over 80-years, Animal Friends has been saving, impacting, engaging, enriching and affecting the lives of the pets and people of our region.  For this day of service, participants will receive a tour of Animal Friends’ facility, help Animal Friends with one or more service projects around the facility (ranging from sorting donations to event preparation, and everything in between), and end the day interacting with some of the resident animals at the facility.  After the event, participants are invited to enjoy food and drinks with the group at a nearby restaurant, hosted by Saul Ewing.

As Artificial Intelligence (“AI”) and generative AI models continue to revolutionize various industries, the potential impact on litigation is profound, reshaping how organizations manage and analyze vast amounts of data in a protected environment. This panel will discuss how AI-driven tools can be leveraged to enhance the efficiency and accuracy of written discovery, document review, and data preservation, all while preventing exfiltration of company data and trade secrets. This panel will also delve into ethical considerations that arise as AI becomes more integrated into legal workflows, with a special focus on the ABA Model Rules of Professional Conduct and the application of the Virginia Rules of Professional Conduct:

  • Rule 1.1 - Competence:  Lawyers must provide competent representation, which may include staying informed about the benefits and risks associated with relevant technology.
  • Rule 1.6 - Confidentiality of Information:  Lawyers are required to protect confidential client information, which      includes understanding how AI tools may impact data security.
  • Rule 1.7 - Conflict of Interest:  Identifying and managing potential conflicts that could arise from the use of AI in client matters.
  • Rule 5.1 - Responsibilities of Partners, Managers, and Supervisory Lawyers:  Ensuring that lawyers within a firm are adequately supervising the use of AI tools to comply with ethical standards.
  • Rule 5.3 - Responsibilities Regarding Nonlawyer Assistants:  Ensuring that AI tools and other nonlawyer resources used in legal work are subject to proper oversight and comply with ethical obligations.
