In a fast-paced hour, you will meet many new and rapidly changing California employment laws. Give them a chance—you might even find some that you like!

Our topics will include presumption of retaliation in certain terminations, workplace violence prevention standards, expanded paid sick leave, still more restrictions on non-compete agreements, and limitations on employers regarding cannabis use.

We also provide timely reminders of our own rapidly developing laws in Illinois and Chicago in some of these same areas.

The Substantial Burden of Religious Accommodation and What to Expect from the Federal Pregnant Workers Fairness Act (PWFA)

Join Jackson Lewis P.C. attorney Mike Moberg for a discussion on accommodations. The United States Supreme Court has clarified the undue hardship burden after 46 years but did not provide detailed specifics about what will be needed to establish undue hardship, leaving plenty of room for arguments in pending litigation. However, it did provide clues to help employers design their internal process going forward. We will clarify what this means for employers both legally and practically.

Additionally, we will discuss PWFA and the practical impact the regulations will have on employers as they handle accommodation requests. We will touch on topics such as the types of conditions and circumstances included under the umbrella of “pregnancy, childbirth or related medical conditions,” how long an employer must excuse an employee from performing essential functions and what your HR team, managers and supervisors need to know about how the EEOC views their obligations.

Join us for a lunchtime roundtable covering need-to-know updates from DOJ and SEC. As the election approaches, hear from McDermott white-collar and securities partners on lessons learned and what to expect. The roundtable will feature a discussion of how companies can enhance their compliance programs in times of greater enforcement, with plenty of time for questions.

Attendees can expect to hear:
1.    Insight from former government lawyers, now McDermott partners – Matt Madden, former Criminal Chief, United States Attorney’s Office, Northern District of Illinois; Paul Helms, former SEC enforcement attorney and counsel to the Enforcement Director; and James Durkin, former federal prosecutor in National Security and Cybercrimes Section, United States Attorney’s Office, Northern District of Illinois.

2.    Updates on current Department of Justice and Northern District of Illinois enforcement priorities, including:
•    Discussion regarding recent high-profile white-collar prosecutions and trials in NDIL and nationwide, including the Outcome Health prosecution led by Matt Madden;
•    Overview of the new cybersecurity legal and compliance requirements (note: thinking of you here James if you’d like to cover some cyber topics – e.g., could talk about ransomware and phishing attacks and what to do about them; theft of trade secrets in cyber breaches, and reporting/compliance requirements re same)

3.    Updates on securities enforcement and regulation, including
•    Discussion of national and regional enforcement priorities; and
•    Considerations in an election year.

ACC Chicago Roundtables are designed to give those who are interested in a particular topic a chance to interact and discuss in an intimate small group session.  Attendance is complimentary but limited to ACC members, other in-house counsel and guests of the sponsor, McDermott Will and Emery.

Employers with an international workforce are having to comply with increasing requirements in relation to pay transparency and reporting requirements.  Some US States already have established pay transparency laws.

A ground-breaking new European Union Pay Transparency Directive introduces significant changes in Europe from 2026 affecting how employers set pay, the information they share with workers and what they must publicly report.  The Directive also covers a wide range of compensation and benefits components.

With global trends towards greater pay transparency and lead-in work needed to be ready for the new laws in Europe, this is a topic that should be high on every global employer’s agenda.

Join our global attorneys as they summarize existing and new laws, the direction of travel, what employers need to do to be ready for the European Directive and why they shouldn’t delay.
