The Substantial Burden of Religious Accommodation and What to Expect from the Federal Pregnant Workers Fairness Act (PWFA)
Join Jackson Lewis P.C. attorney Mike Moberg for a discussion on accommodations. The United States Supreme Court has clarified the undue hardship burden after 46 years but did not provide detailed specifics about what will be needed to establish undue hardship, leaving plenty of room for arguments in pending litigation. However, it did provide clues to help employers design their internal process going forward. We will clarify what this means for employers both legally and practically.
Additionally, we will discuss PWFA and the practical impact the regulations will have on employers as they handle accommodation requests. We will touch on topics such as the types of conditions and circumstances included under the umbrella of “pregnancy, childbirth or related medical conditions,” how long an employer must excuse an employee from performing essential functions and what your HR team, managers and supervisors need to know about how the EEOC views their obligations.
