While California employers understand that our state’s employment law landscape is in a constant state of flux, most focus their attention on changes to the law as they come. While certainly important to do so, review of new or revised laws in a vacuum can obscure perception of larger shifts in policy/thinking.

This presentation will use the “micro” as a jumping off point to view the “macro,” discussing trends in recent case and statutory law to examine developments and areas of focus then extend beyond the specificities of the changes themselves.

Hon. Halim Dhanidina (Ret.) and Suzanne Burke Spencer will discuss the new California Rule of Professional Conduct, Rule 8.3, the so-called “snitch rule,” which requires, amongst other things, attorneys to inform the state bar when they are in receipt of credible evidence that a fellow attorney has committed a criminal act or engaged in certain conduct involving dishonesty, fraud, deceit, or reckless, or intentional misrepresentations.
