What to Expect When Employees are Expecting - New PWFA Accommodation Challenges

Presented by: Alyssa Gonnerman and LaceShionna Cline

Thursday, November 21, 2024

12:00 – 1:00PM | Registration begins at 11:30am
Grand Street Café, 4740 Grand Avenue, Kansas City, MO 64112

 Program Summary:

The Pregnant Workers Fairness Act (PWFA) took effect in June 2023. It requires employers to provide reasonable accommodations to employees for conditions related to, affected by, or arising out of pregnancy, childbirth, or related medical conditions.

Join us for a dynamic discussion of emerging themes in requests for accommodation from employees trying to become pregnant, are pregnant, or are resuming work after pregnancy. While the PWFA adopts key ADA concepts, it differs in significant respects. Littler attorneys Alyssa Gonnerman and Lace Cline will summarize what the law requires and how we expect the EEOC to construe the PWFA based on the recently published final regulations.

By applying key terms to actual situations, we will help attendees identify where updates to their interactive accommodation processes are warranted. We also will address the interplay of this new law with the ADA, the FMLA, the Pregnancy Discrimination Act, and the PUMP Act, and discuss how application of the PWFA may differ for employers who grant light-duty accommodations in workers’ compensation schemes and other contexts. We will also highlight how employers may need to modify interactive process forms and medical documentation requests in response to the PWFA.

Discussion Topics & Objectives:

  • Review the Pregnant Workers Fairness Act (PWFA) and define reasonable accommodations (15 minutes)
  • Summarize the key concepts of PWFA, ADA, FMLA, Pregnancy Discrimination Act, the PUMP Act, how they work together, and employer applications (30 minutes)
  • Discuss the legal implications and documentation requirements in response to PWFA (15 minutes)

We encourage members to bring an associate or colleague that may be interested in joining the ACC Mid-America Chapter. The Association of Corporate Counsel offers numerous benefits and resources to in-house counsel including CLE offerings and networking opportunities and we look forward to sharing that information with others in the field.

Entities in the healthcare space that engage independent sales representatives to promote their or others' products should be mindful of the regulatory considerations and risks associated with how those representatives are compensated. Kyle Faget and Larry Vernaglia from the HLN's sponsor firm, Foley & Lardner LLP, will discuss how such representatives are compensated, what risks are involved, and what steps you should consider to help ensure that those arrangements will withstand legal scrutiny.

State and federal legislatures and administrative agencies were busy in 2024 when it came to the patchwork of laws and regulations governing workplaces and work forces.  And 2025 looks to be no different.  From enhanced whistleblower protections and enforcement activity, to efforts to ban or limit the use and enforcement of non-competes, to a sharp increase in mental health-related workplace accommodations and requests for leave and remote work, to updates to wage and hour law, change has been omnipresent.  Add the uncertainty surrounding the upcoming presidential election, and it has been difficult for employers to keep up with all of it and to know what to expect.

In this interactive, engaging, and informative half-day program, in-house leaders and experienced attorneys from Epstein Becker & Green will address the changing landscape and provide practical solutions for thriving in this new reality, including how best to prepare for the known and unknown without disrupting established workplace cultures and values.

Hosted by ACC Northeast and Epstein Becker Green, P.C., this event offers an opportunity to network with other in-house professionals and attorneys from the firm. There will be ample time for Q&A, and breakfast and lunch will be provided.
